Photos of what may be Apple's next iPhone surfaced online Monday.

Posted by a Chinese technology site, the images allegedly show the iPhone 5S already going into production. Nearly identical to the iPhone 5, the handset shown in the photos has an updated vibration motor (some have complained the iPhone 5's is too noisy). Beyond that minor difference, however, it looks identical to the model currently on the market. Apple launched the iPhone 5 last September.

The Chinese site also suggested that an iPhone 6 was on the way, soon. It said the 6 will sport a larger display, increasing from 4.8 inches to 5 inches.

This past weekend, rumors surfaced that the Cupertino, Calif. company was also working on a smart watch. Made out of curved glass, the watch can potentially let users to make calls, answer texts and run apps from their wrists.

No "Plan B" for Microsoft's mobile ambitions: CFO

SEATTLE (Reuters) - Microsoft Corp has not made much of a dent in Apple Inc's and Google Inc's domination of mobile computing, but a top executive hinted on Wednesday that it will not stop trying and does not have an alternative strategy.

"We're very focused on continuing the success we have with PCs and taking that to tablets and phones," Microsoft's Chief Financial Officer Peter Klein said at the annual Goldman Sachs Technology and Internet Conference in San Francisco, which was webcast.

Given Microsoft's lack of success so far, he was asked if there was an alternative strategy or 'Plan B' in reserve.

"It's less 'Plan B' than how you execute on the current plan," said Klein. "We aim to evolve this generation of Windows to make sure we have the right set of experiences at the right price points for all customers."

Microsoft now has two versions of its own brand Surface tablet for sale and released its newest Windows phone software last year. But the company has not made big inroads into either market.

Gartner estimates that Microsoft sold fewer than 900,000 Surface tablets in the fourth quarter, which is a fraction of the 23 million iPads sold by Apple. Microsoft has not released its own figures but has not disputed Gartner's.

Windows phones now account for 3 percent of the global smartphone market, Gartner says, which is almost double their share a year ago but way behind Google's Android with 70 percent and Apple with 21 percent.

To grab more share, Klein said Microsoft was working with hardware makers to make sure Windows software is available on devices ranging from phones to tablets to larger all-in-one PCs.

"It's probably more nuanced than just you lower prices or raise prices," said Klein. "It's less a Plan B and more, how do you tweak your plan, how do you bring these things to market to make sure you have the right offerings at the right price points?"

Klein did not say whether Microsoft itself was planning to move into the growing small tablet market, following the success of Apple's iPad mini, Google's Nexus 7 and Amazon.com Inc's Kindle Fire tablet.

Along with its partners, Klein said only that Microsoft was "well set-up to deliver the most versatile set of experiences across form factors".

Regarding Microsoft's $2 billion loan to Michael Dell and private equity firm Silver Lake to take PC maker Dell Inc private, announced last week, Klein suggested it was simply part of its efforts to support the "ecosystem" of PC makers.

"We have a long history of participating and supporting the ecosystem and that takes different forms. Oftentimes it takes the form of co-marketing, sometimes in helping with development," said Klein. "In a very dynamic industry, our ability to support the ecosystem - particularly the ecosystem that is innovating on our devices and platforms - is a good thing and something we will continue to do."

Apple loses right to use iPhone trademark in Brazil: WSJ

(Reuters) - Brazil's copyright regulator on Wednesday stripped Apple Inc of the right to use its iPhone trademark in that country, the Wall Street Journal reported on its website on Wednesday.

The agency that oversees patents in Brazil said Gradiente Electronica SA, a Brazilian consumer electronics maker, already owned the rights to the iPhone name, according to the report.

Apple will be able to challenge the ruling in the Brazilian courts.

Earlier this month, sources told Reuters that the regulator, the Brazilian Institute of Intellectual Property, was likely to make the decision that Apple did not have the rights to the trademark.

Gradiente Electronica registered the "iphone" name in 2000, seven years before Apple launched its popular smartphone.

A spokesperson for Apple in the United States was not immediately available to comment.

Instagram asks court to throw out lawsuit over service terms

(Reuters) - Facebook's Instagram photo sharing service asked a federal court on Wednesday to throw out a lawsuit filed against the popular app over changes to its terms of service.

The proposed class action lawsuit was filed in San Francisco in December by an Instagram user who leveled breach of contract and other claims against the service.

Instagram last year rolled out and then amended policy changes that incensed users who feared the photo-sharing service would use their pictures without compensation.

In Wednesday's filing, Instagram argues that the plaintiff, Lucy Funes, has no right to bring her claim because she could have deleted her Instagram account before the changes in the term of service went into effect.

The changes in the terms of service were first announced on December 17 and then altered a few days later following widespread user complaints.

Funes sued the company on December 21, nearly a month before the changes in the terms of service went into effect on January 19, the court papers said.

She continued to use her account after that day, according to Instagram's filing.

Instagram also disputed Funes' claims that the new terms required her to transfer rights in her photos to the company.

Both the old service terms and the new ones "emphasize that owns the content she posts through Instagram's service," the filing said.

An attorney for the plaintiff was not immediately available for comment. Facebook declined to comment.

In announcing the revised terms of service in December, Instagram also announced a mandatory arbitration clause, forcing users to waive their rights to participate in a class action lawsuit except under very limited circumstances.

Following user backlash, Instagram founder and CEO Kevin Systrom retreated partially, deleting language about displaying photos without compensation.

However, Instagram kept language that gave it the ability to place ads in conjunction with user content, saying "that we may not always identify paid services, sponsored content, or commercial communications as such." It also kept the mandatory arbitration clause.

Instagram, which allows people to add filters and effects to photos and share them easily on the Internet, was acquired by Facebook in 2012 for $715 million.

The civil lawsuit in U.S. District Court, Northern District of California, is Lucy Funes, individually and on behalf of all others similarly situated vs. Instagram Inc., 12-cv-6482.

Yahoo CEO says Microsoft search deal underperforms

SAN FRANCISCO (Reuters) - Yahoo Inc Chief Executive Marissa Mayer said the company's search partnership with Microsoft Corp was not delivering the market share gains or the revenue boost that it should.

"One of the points of the alliance is that we collectively want to grow share rather than just trading share with each other," Mayer said at the Goldman Sachs Technology and Internet Conference in San Francisco on Tuesday.

In her first appearance at an investor conference since taking the reins of the struggling Web portal in July, Mayer said she planned to prune a sprawling lineup of mobile apps and she reiterated her focus on enticing consumers to spend more time on Yahoo's online properties, in order to display more money-making ads.

"I'm not confused. Our biggest business problem right now is impressions. Basically can we grow impressions, can we get growth happening here," Mayer said.

Yahoo shares finished Tuesday's regular trading session up 31 cents at $21.21.

Mayer, 37, took over after a tumultuous period at Yahoo in which former CEO Scott Thompson resigned after less than 6 months on the job over a controversy about his academic credentials and in which Yahoo co-founder Jerry Yang resigned from the board and cut his ties with the company.

Yahoo's revenue in 2012 was flat year-over-year, at roughly $5 billion, and down from roughly $6.3 billion in 2010.

"We need to see monetization working better because we know that it can and we've seen other competitors in the space illustrate how well it can work," Mayer said of the search deal with Microsoft.

Yahoo and Microsoft entered into a 10-year search partnership in 2010, hoping their combined efforts could mount a more competitive challenge to Google Inc, the world's No.1 search engine. But the partnership has not lived up to expectations.

Google remains the dominant search engine, with a 66.7 percent share of the U.S. market in December, almost unchanged from its 66.6 percent share two years earlier, according to online analytics firm comScore.

Microsoft had 16.3 percent share and Yahoo had 12.2 percent share in December, a reversal of two years earlier when Yahoo's U.S. search share was 16 percent and Microsoft had 12 percent share.

Yahoo's stock has risen more than 30 percent since Mayer took the helm in July, reaching its highest levels since 2008.

Analysts say that part of the stock's rise has been driven by significant stock buybacks, using proceeds from a $7.6 billion deal to sell half of its 40 percent stake in Chinese Internet company Alibaba Group.

Mayer said that she viewed the company's relationship with Yahoo Japan, which is partly owned by Softbank, as "strategic" to the company. Under previous CEOs, Yahoo had engaged in unsuccessful discussions to "monetize" its roughly 35 percent stake in Yahoo Japan.

Pentagon stands by use of lithium-ion batteries on F-35 fighters

WASHINGTON (Reuters) - The Pentagon said it plans to continue using lithium-ion batteries on the new F-35 fighter jet despite problems with similar batteries that have grounded Boeing Co's new 787 airliner and are causing Airbus to rethink their use on its A350 jet.

Joe DellaVedova, spokesman for the Pentagon's $396 billion F-35 program office, said on Tuesday that the lithium-ion batteries used on the new radar-evading fighter were made by different manufacturers than those used on the 787, and the jet's battery systems had been rigorously tested.

"The bottom line is the lithium-ion batteries used on the F-35s have been through extensive tests and have redundant systems to protect the aircraft and battery compartments; they are considered safe," DellaVedova said.

DellaVedova said there had been some irregularities with the lithium-ion batteries not starting properly in cold temperatures that were being addressed, but no issues affecting flight safety had come up during years of testing.

All 50 Boeing Dreamliners in commercial service were grounded worldwide on January 16 after a series of battery-related incidents, including a fire on board a parked 787 at Boston's Logan International Airport and an in-flight problem on another airplane in Japan.

The groundings have cost airlines tens of millions of dollars, with no solution yet in sight, and have sparked growing concerns among aerospace industry executives about whether the powerful but delicate backup energy systems are technically "mature", or predictable.

The U.S. National Transportation Safety Board, which is examining the 787 fire in Boston, said it was looking at the total design of the Boeing 787 battery, built by Japan's GS Yuasa Corp on behalf of France's Thales SA, including the charging system, electrical interconnections, and their thermal isolation of different battery cells from each other.

BATTERY SAFETY

Two of the biggest lithium-ion batteries on the F-35 warplane are made by the French company Saft Groupe SA, which also makes batteries for Airbus, part of European aerospace group EADS NV. Saft last month expressed confidence that lithium-ion technology was safe.

But people familiar with the matter have said that Airbus officials are reconsidering use of the batteries on the A350, which would be the second large passenger jet to fly on lithium-ion batteries for backup electrical power after the Dreamliner, which pioneered their use in passenger transport to support an increasing array of electrical systems.

Airbus said last week it had a plan B for its battery and time to respond to any rule changes.

DellaVedova said military officials remained confident in the lithium-ion batteries used on the F-35, and there were no discussions under way to swap them out for heavier nickel-cadmium batteries.

Lockheed Chief Executive Marillyn Hewson last month underscored her confidence in the lithium-ion batteries, telling reporters that the batteries on the F-35 were made by a different company and had been tested extensively.

Lockheed spokesman Mike Rein said more than a dozen F-35 jets were wired with extensive monitoring equipment to carry out development testing and no flight safety issues had been detected with the batteries during over 6,000 hours of flight testing on the airplanes.

"We are monitoring our full battery system on a daily basis as we flight test. We have continual data updates, and we've had no indication that we are connected to the same issues that grounded the 787," Rein said.

The F-35's battery system has run into a different problem on the ground, with some airplanes failing to start during cold temperatures under 10 degrees Celsius, DellaVedova said.

He cited "minor irregularities" that had been traced back to a software issue in the jet's battery charger control unit, and a fix was in the works for new jets in production and would be retrofitted on earlier jets. The problem, he said, was not related to the batteries themselves.

In the meantime, he said, measures were being taken to warm the area near the battery on cold days prior to start.

One defense official said maintainers at Eglin Air Force Base in Florida were using space heaters in some to warm the jets, which required removing a panel of the plane's stealthy coatings. "It's not ideal when you're talking about a fighter jet that has to be ready to go at a moment's notice," said the official, who was not authorized to speak on the record.

Separately, the Pentagon's F-35 program office on Tuesday lifted a January 18 order that grounded nine F-35B developmental test aircraft after a fuel line detached just before a training flight at Eglin Air Force Base in Florida.

Vice Admiral David Dunaway, head of Naval Air Systems Command, was briefed Tuesday on the inspections of the faulty components, and could lift flight restrictions on 16 additional F-35B model jets being used for training as early as Wednesday, according to two sources familiar with the matter.

Telenor sees margins improving after tough Q4

OSLO (Reuters) - Mobile telecoms firm Telenor expects steady growth and improving margins in 2013, after its fourth-quarter profit missed forecasts and it made an unexpected impairment charge on its Danish operations.

Telenor, which has around 150 million customers in Europe and Asia, expects organic revenue growth of 3 to 5 percent this year after last year's 5 percent, and it sees its earnings before interest, taxes, depreciation and amortization (EBITDA) margin widening to 34 percent from 32 percent, it said on Wednesday.

The firm also plans to increase capital spending after concluding a license agreement in India, which ended almost a year of uncertainty and raised the prospect that it would have to exit one of the world's biggest markets.

"We now see the opportunity to accelerate investments to capture market positions and expect capex/sales in the range of 12-14 percent (up from 12 percent in 2012)," Chief Executive Jon Fredrik Baksaas said.

Telenor's fourth quarter missed expectations and included a nasty surprise of a 4 billion Norwegian crown ($729 million) charge related to its Danish operations.

The company said the Danish market is more competitive than it expected, leading to price wars among telecom firms and shrinking margins, which forced it to lower its future profit expectations for the unit.

Excluding the charge, its adjusted operating profit rose to 4.498 billion crowns from 3.533 billion a year earlier, still missing analysts' expectation for 4.597 billion crowns.

Judge speeds up schedule in Apple versus Einhorn case

SAN FRANCISCO (Reuters) - A judge approved Apple Inc's request to speed up the schedule in a lawsuit filed by star hedge fund manager David Einhorn's Greenlight Capital, part of an effort to get the company to share its huge cash reserves with investors.

U.S. District Judge Richard Sullivan of the Southern District of New York on Monday brought forward the legal schedule by a few days at Apple's request, which argued that the issue would have a big impact on the upcoming shareholder meeting on February 27.

Apple told the judge that the request to modify the schedule had the support of Einhorn's counsel.

Einhorn, a well-known short-seller and Apple gadget fan, shocked Wall Street last week by suing Apple to stop the iPhone maker from eliminating from its charter the ability to issue preferred stock without shareholder approval.

He wants Apple to return a bigger piece of its $137 billion cash pile to investors, through the issuance of perpetual preferred shares that pay dividends to existing shareholders.

Einhorn is objecting to how the proposed charter change is bundled together with two other corporate governance-related proposals in the proxy document for the annual meeting.

The lawsuit contends Apple violated Securities and Exchange Commission rules that prohibit companies from "bundling" unrelated matters into a single proposal for a shareholder vote.

Apple says removing the board's ability to issue preferred stock at its discretion heightens governance, because future issuances would then require shareholder approval.

The company will file its response to the lawsuit by the end of Wednesday while Greenlight will file its own response papers by Friday. The judge ordered both parties to appear for oral arguments on February 19.

Apple has said that the proposal in its proxy had the support of many shareholders, and striking such a "blank check" provision from its charter would not preclude preferred share issuances in future.

The law firm of O'Melveny & Myers LLP is representing Apple in the case, with San Francisco-based partner George Riley arguing for Apple.
